I recently had the privilege of training in the field of global sports regulation at IDHEAP (Institut des hautes études en administration publique) and at the faculties of law and criminal sciences at the University of Lausanne. You will find details of this training, which took place in English, under www.unil.ch/idheap/casregs
The aim for me was to understand the whole issue of doping, medication and contamination from a legal point of view because, as you are no doubt aware, WADA regulations use the rule of strict liability. This practice requires the person responsible (PR) to demonstrate how a detected substance entered the body of a horse that has tested positive and this at great expense of experts and lawyers.
During the examination and diploma thesis that led to this CAS (Certificate of Advanced Studies), I had the opportunity to look into this issue and I invite you to read the attached document entitled:
"Equestrian Sports (FEI) - Concept Clean Sport - The case of food contamination analyzed from the point of view of strict liability and proportionality - Proposals submitted to the FEI for a revision of the EADCMR regulations (Equine Anti-Doping and Controlled Medication Rules)"
